Terms & Conditions

The Shopify integration for MODX is built, maintained, and offered by modmore, in collaboration with Sepia River Studios. It consists of the MODX Shopify App, the webservice, your MODX website, and the modshop MODX extra. Collectively, we refer to this as the Integration.

Your use of any part of the Integration is governed by these terms.

General

1. The Integration is managed and maintained by Mark Hamstra Web Development (Oenemastate 14, 8962 PR, Leeuwarden, The Netherlands, Chamber of Commerce 52454606).
2. We take great care in providing the Integration. We cannot guarantee that it will work uninterruptedly and/or is free of errors. We explicitly note that your use of the Integration contains services and tools that are not under our control and your sole responsibility.
3. We strongly encourage checking for updates regularly and staying up-to-date. At time of writing, a minimum of MODX 3.0 and PHP 8.0 are required for the MODX extra, which may change with future updates.

Privacy & Cookies

1. We respect your privacy and follow the framework of the GDPR to protect your personal data. We limit what data we collect to the bare minimum, and what data we do collect is processed carefully, securely and in accordance with our privacy policy. The privacy policy forms an integral part of these terms and conditions.
2. We only use functional first-party cookies and do not track, profile, or otherwise seek to benefit from any data provided in any way.

Payment

1. At this time, use of the Integration is free. We do not charge commission on orders placed through the integration, nor do we charge a monthly fee for use of the Integration. We may charge a one-time setup fee or license fee on a per-project basis.
2. We reserve the right to discontinue our free service and to replace it with a paid service at any time. In this event, as a courtesy, existing users will be given a minimum of 3 months notice to upgrade to a paid plan.
3. Support is not included in the free service. We are happy to offer you a support plan.

Changes to terms of use and services

1. We have the right to amend these terms of use if, in its opinion, this is necessary or desirable and without requiring your consent. Amendments to the Terms of Use shall be effective immediately, unless otherwise specified in the amendment.
2. We may change (parts of) the Integration and associated websites or services at any time. We may also discontinue our services. We will endeavour to give reasonable notice of any such change or discontinuance before they take effect.

Liability

1. The relationship between modmore and users is exclusively governed by Dutch law.
2. We exclude, to the extent permitted by law, liability for any damages (direct or indirect) that a user suffers as a result of use of the Integration and/or the Integration not being available (or safely) and/or incorrect information of the Integration and/or changes in the services provided or changes in/on the Integration or websites.
3. If we, for whatever reason, are liable, then our liability is limited to the maximum total compensation that user has paid to modmore for the Integration (incl. compensation paid via Shopify's App Store, if any; excluding any payments made to modmore for other products or services offered that are not part of the Integration) during the six months preceding the act giving rise to the liability or up to EUR 200, whichever is higher.
4. You indemnify us against all claims by third parties, including (prospective) customers of your Shopify or MODX storefronts.
